Man suing Dave Matthews Band for stage injury

TribLIVE: An Esplen man is suing the Dave Matthews Band for what he claims was negligence when one of their roadies caused him to fall off the stage.

First of all, why did Lynham wait two years to sue? Those two years of silence only hinder his chances on winning the case. A six foot drop does not seem that bad either. If it was a 20 foot drop, I would feel more sympathy. I have severe problems believing Lynham and his claim against the Dave Matthew’s Band. The band itself, as he phrases it, did nothing to hurt him and the quotations around the name Hank do nothing to help prove his case. Not knowing the name, and suing the band, that did nothing itself, makes for a very flimsy case in my mind. Granted his lawsuit is only $25,000, which is low for lawsuits nowadays, and the band representatives did not respond, this case has weak legs. I highly doubt that this case will go far in court, for the evidence does not seem to hold itself up in this article.

Being a roadie has certain dangers one must be aware of when signing up for the job one of which is falling off the stage. It's not uncommon for stagehands to injure themselves while working ny just doing what they need to with out interaction from others. How can it be for sure that "Hank" moved Richard Lynham? Is it not possible Mr. Lynham fell on his own?

This article would be a lot clearer if the section on the perpetrator, the one known only as 'Hank.' The article explains that 'Hank' is the one at fault for this hefty six foot fall, but fails to explain why. I do hope that the Mr. Lynham feels better, but it was quite a poor article.

All I'm getting from this article is that Lynham wants money from the Dave Matthews band. The man signed up for a job that has known risks, and was injured on it. if he didn't know the risks involved with rigging he should not have signed up for the job. The fact that he also waited two years to sue the band is just ridiculous, the only reason I can see for such a long wait is an injury that seemed harmless at first, but revealed complications later on. The article is brief and vague, which just confuses the situation.
