Hmm something smells rotten here. A person fell due to the throngs of people and cutouts in the sidewalk and as a result had to take over 8 months out of work and racked up more than 1 million in medical bills. Looking at this from a purely legal perspective, I can’t imagine why I would allow this case, if it were to come before me, proceed against the Television academy or AEG. Neither of them were responsible for the cutout in the sidewalk that was clearly contributory to the accident. However, that does not mean that the City of Los Angeles is at fault either. I am sure that hundreds, if not thousands, of these cutouts exist around the city. I would also be curious about the other factors of that night. Weather, lighting, alertness of the now injured party, type of clothing or shoes that this person wore and so forth. The article only mentioned the throng of people and the poor lighting. Though with this being an event likely to attract celebrity guests, I would imagine that even at the end, press were still there and there would have been a lot of light. I’m also concerned how a person who is the exec vp of a major television studio could end up with over a million dollars in bills. Did this person not have insurance as part of their compensation package? Also, did they not get time off or vacation/sick time to use? Too many questions remain unanswered.
