MPAA Suffers Legal Setback in Big Copyright Decision

Hollywood Reporter: The 7th Circuit Court of Appeal has handed down a potentially landmark decision in a case dealing with copyright infringement on the Internet. The dispute involved a social video bookmarking site that was sued by the owner of gay erotica. The case aroused the interest of such major players as the MPAA, Google and Facebook, all of which submitted amicus briefs.

It will be interesting to see if Judge Posner's decision has any bearing on the ongoing MegaUpload trial. It would seem that both websites argue the same point, that they are merely funnels and address books for all content, illegal or not. I do not understand why the MPAA does not choose to go after actual copyright infringers rather than websites that do host legal content.

Is a hotel manager responsible for illegal actions in his rooms? Is a landlord responsible for illegal actions in his apartments? They cooperate with the authorities, just like MyVidster cooperated with the takedown notices. The best that they can offer is, "I do what I can", and just the same should be expected of MyVidster.
