‘Midnight Rider’ First AD Hillary Schwartz Guilty; Gets 10 Years Probation
Deadline: Midnight Rider’s first assistant director Hillary Schwartz was found guilty of criminal trespass and involuntary manslaughter today and will receive 10 years probation and no prison time. Under terms of the deal, she cannot be a director or assistant director, but she can be a producer in a capacity other than overseeing the safety of others. She also was slapped with a $5,000 fine.

This is one of those complicated cases where you definitely want to see those responsible for such a senseless tragedy, but knowing exactly how much is a struggle. There are definitely parts of me that don’t think that two years in jail and 8 years probation is at all enough for being enough of an idiot to accidentally kill someone who was working for you. However, it is hard to reconcile that impulse with the knowledge that those responsible for the incident are heartbroken and guilt ridden with the fact that their actions resulted in the death of an innocent person. I think the problem is that it in my mind it keeps boiling down to the price of a human life, which is something that we all agree in this industry is extremely more valuable than any artistic or financial gain that may be accrued from unsafe practices. But in the case where a mistake (an incredible show of willing and knowing lack of concern for safety, but one with no intentions to hurt anyone) results in the death of a person, what happens? Is 2 years in jail enough? I’d prefer not to have to deal with the situation at all and just do everything possible to keep a safe environment.
