More Research Shows How The Fashion Industry Is Helped By The Lack Of Intellectual Property Rights

I am researching "Intellectual Property Rights" right now, and mainly the positive aspects of such protection. It is interesting to see the other side defended. I can also understand how putting such laws in place can kill the creative drive that is currently fueling the fashion industry. So how to we address the issue of copyrighting without killing the creative progression?

I somewhat agree with Candace in saying that by putting these property rights into affect in the fashion industry wouldn't kill the creativity of the fashion industry however, I do believe that in fashion almost everything has been done with slight modifications. So if these rights were put into effect, what would happen when all the base items were under the rights of some other designer. What happens if/when the designer's take these rights a bit too far.

I think the designers are already taking advantage of these right now. Well, I guess it really depends on the class of the designer's popularity, and talent, but fashion, in particular, repeats itself within ten years. The leggings, mini skirts are already back from the 90s. It won't be too far for us to see the baggy pants again in next five years. I don't think there is a line that distinguishes the copying someone's work and being creative, since there isn't anything creative after Shakespeare.

A shirt is a shirt. So if one person copyrights the shirt does that mean that no one else can use it? Perhaps some things need be copyrighted but this is a process that would certianly have to be moderated very carefully.
