Alex Schmidt over at Cracked (the comedy site that has caught our attention with its understanding of these kinds of topics before) makes the compelling case that they should

While drastic action is required putting these characters in public domain is far too drastic of a move and would have very few benefits for DC, instead they should revamp the entire franchise, if you have a director who isn't incredibly passionate about the project then the fans won't be either. DC should realize that while these movies are currently turning a profit, putting out bad movies and hoping for initial fan reaction and fan loyalty to carry you is not a sustainable business model. I believe that DC needs to make some changes quick, however, if they were to follow in Marvel's footsteps and make more lighthearted movies they would be betraying the source material of characters like Batman. A few days ago the first Justice League trailer dropped and it showed the interaction between Batman ( Ben Affleck) and The Flash (Ezra Miller), which gave me hope for the future of DC, it is the interactions between such different characters that creates compelling dialogue and I believe DC needs to work to accentuate those qualities of it's work.
